Transportation Regulation

Motor carriers in California are heavily regulated. The state tells carriers how long they can be on the road and the maximum weight of the cargo that they are supposed to carry. Carriers are subject to fees, vehicle inspections, and maintenance record inspections. If the inspectors find that a carrier is not up to code, they notify the carrier. The carrier only has a certain number of days to fix the problem. Sometimes they have to pay a fine and in other cases their entire operation may be suspended by regulatory agencies such as the California Highway Patrol or the United States Department of Transportation.

This firm regularly provides counsel and advice regarding international, federal, and state regulations. They assist carriers in their efforts to avoid censure and remain compliant with the law. They are experienced with the requirements put forth by the Administrative Procedures Act. They have represented clients against the California Highway Patrol, The California Department of Motor Vehicles, the California Public Utilities Commission, the California Department of Industrial Relations, Labor Commission, United States Department of Transportation, Federal Motor Carrier Safety Administration, as well as other state and federal agencies.

In addition, Chauvel, Abraham & Descalso, LLP provide representation in civil court. They provide counsel to, shippers, motor, bus and other carriers who face personal injury, cargo or freight damage claims under federal, state, international, or maritime law. They also represent them on appeal, if necessary.
